The operator from „DerLauftipp.de“ with all asocciated domain names is in the following defined as „Lauftipp“

The user of the page(s) editing, up- and downloading content to the page(s) will ba named as „User“

Tracks, trails, pictures, descriptions, hints, guidances and all other information edited by the User is defined as „Content“.

The User of Lauftipp accepts fully the existing and future Terms and Conditions from Google Maps.

Right of withdrawal

We allow a temporary right of withdrawal for goods purchased via Lauftipp for 14 days after shipment.
Withdrawal has to be done in written form either trough our contact page or by sending an e-mail to info(at)derlauftipp.de or by re-shipping the goods to:

Reshipment of Goods

Reshipment has to be done in a propper packaging, so that goods will not be damaged during shipment.
Please ensure to stamp the shipment propperly. Any costs that occur will be substracted from your credit.

Please make sure: All goods have to be stamped sufficiently to be accepted when returned.

Voluntary acceptance of returned goods

We only accept returned goods when the products are unused and if they are in the original carton and packaging as well as in a propper shipping package.

Payment process

If nothing else is agreed payment takes place via PayPal. This means also crediting will go trhough PayPal and we will credit your account there.

Terms of usage for Lauftipp and its associated pages

This portal is based on the idea of a so called „Internet-Community“

Lauftipp just offers the platform for their users and is therefor not the owner of the content and will therefor not comment any requets for the content. The full responsibillity for the content lies solely at the User. Lauftipp will react adequately if Lauftipp gets knowledge that Users offend the rights of third parties by entering content or that content offend these terms.

Create Content

All Content created within Lauftipp will be allocated by the User free of charge and wihtout any time restriction to Lauftipp.

Because Content is created by the User, Lauftipp will not check every sinlge Content. If Content violates these terms or rights of third parties, the Content will be deleted and the User excluded.

The copyright for the Content belongs to the particular User. He (or she) ensures not to offend against copyrights of third parties. The User indemnifies Lauftipp fom any warranty claim from third parties. The User grants Lauftipp an infinite and free of charge right of utilasation for the Content.

Contacting other Users

Lauftipp ist nicht verantwortlich für den Inhalt, der beim Verbinden mit anderen Läufern übertragen wird. Jeder gemeldete Missbrauch wird aber sofort geahndet. Beim Verdacht auf Gesetzesbruch wird sofort Strafanzeige erstattet

Misusage/Abuse

Misusage/Abuse of this internet platform means the immediate exclusion of the User. We keep us the right to initiate further steps and sue the User under civil law. In case of a reasonable suspicion that a User offended law Lauftipp has the right to support public authorities and will pass only in this case personal data to the authorities.

Utilisation of Content

Die Vervielfältigung auch von Teilen des Inhaltes durch Dritte ist untersagt und bedarf der schriftlichen Genehmigung des Urhebers UND Lauftipps.

Lauftipp behält sich vor, Inhalte der User zu verändern, löschen oder kopieren, sofern es erforderlich scheint oder die Inhalte fehlerhaft sind.

Der User stimmt zu, dass die gespeicherten Daten für Marketingmaßnahmen genutzt werden dürfen.

Download and Usage of Tracks

The Content within Lauftipp is only for private usage. While downloading fils and tracks from Lauftipp the User downloading it will not obtain any rights on the Content. Downloading any content the user accepts automatically the terms of use from Lauftipp. Lauftipp is not responsible for the tracks and the routing. The User himself is responsible not to offend law and rights of third parties (e.g. access to property, usage of private ways and roads, etc...). Lauftipp will not take over any liabillities for the usage of the Content.

Backup of Data

All data of Lauftipp will be backuped regularely to prevent data loss. The User accepts that all personal and non-personal data will be saved during this routine.

The User is obliged:

• to be polite, tolerant and fair against other Users.

• to publish solely true and reliable Content to create Content in all consience and not to offend rights of third parties.

• give solely true and real data in the personal profile and while communicating with other users.

• just to use fotos of his/her person not being older than five (5) years and on which the user is clearly recognised.

• to make sure that the foto can be published without offending the rights of third parties. Submitting other fotos than from onesself e.g. not existing persons, animals, fantasy creatures or pictures from another person than yourself ist not allowed. All submitted pictures do not contain logos from companies. Fotos from Lauftipp-employess are excluded from thies rules.

• to obey law and order and the rights of third parties while using Lauftipp.

• to make sure not to offend law, rights of third parties or the terms of Lauftipp with the chosen user name. Especially names from other persons and/or names under copyright must not be used. Vulgar, bawdy or offending user names must not be used.

• to choose a safe password to prevent that others will get access to the personal data and the Content set up by the User. Also the password has to be kept secret so that third parties will not get unauthorised access to any data within Lauftipp. Lauftipp is not liable for the loss of data or the missuse of the User-account. If Lauftipp gets knowledge of the missuse of the account, the account will be closed immediately and the User will be excluded.

It is explicitly forbidden:

• to publish offending or untrue Content

• to publish Content that is either pornografic or break law.

• to publich Content that might offend other people because of their religion, color or descent.

• to molest other Users sending e-mails they do not want to receive.

• to use Content protected by law (e.g. copyrights, brand name rights, patent law, etc...)

• to use Lauftipp for trying to send out mass mails

• to send mass mails or mail with the same content to many users or to send advertisement mails to the users of Lauftipp or to advert for a product or to use Lauftipp for own marketing purposes.

• to use mechanisms, software oder scripts while using Lauftipp

• to block, overwrite, modify or copy Content or to copy Content trough any „Robot/Crawler“-Search engine-Technology.

• to publish or to spread Content without allowance from Lauftipp and the User as the owner of the copyright.

• to initiate any action that might be able to reduce the functionality or the performance of Lauftipp.

• to break copyrights using fotos from third parties.

Liabilities

Using content from Lauftipp happens on your own risk. Lautipp and the Users providing the Content exclude any libilities that might occur while using Content from this offering.

Damages on your System, loss of data, personal damages, or damages on any object that might occur while using Content from Lauftipp are excluded from any liabilities. Help or information you might get from Lauftipp or the Users do not implicit the right for warranty of liability claims. The services from Lauftipp are offered without any guarantee that the services are available without any interruption in a special time frame or with a special performance or with errorfree Content or functions. Lauftipp does not take over any liabilities for the correctness and the reliability of the Service or the Content.

Lauftipp is not liable for the behavior of the Users or any other third parties or the Content or for any information provided by the Users or other third parties. Lauftipp is also not liable for any damages that might occur while using or even while NOT using the Content of Lauftipp.

Termination or Cancellation of your membership

You can quit your membership at any time and without any deadline.Lauftipp has also the right to end your membership any time and without any deadline or time frame.

In case Lauftipp cancels your membership with immediate acction a re-registring of the User is just possible after explicit permission from Lauftipp.

The right to end your membership due to an *imporant reason* is not affected by these Terms. Just send an e-mail to info(at)derlauftipp.de. All user-specific data will be deleted.

Lauftipp reserves itself the right to keep all Content provided by the User even though the User ends the membership and to publish the Content under the name of Lauftipp. The right of usage of the Content transferred to Lauftipp by the User when he enters Content is not affected and remains free of charge and without any limitation.

Links to Lauftipp

Links from other pages to Lauftipp even from comercial websites are welcome, if it is clear that Lauftipp is an independend service and is not overwritten by any other website. It is not allowed to integrate directly Content in your own webpage if it is not clear that the Content belongs to Lauftipp and is offered as an independend service.

Final Clauses

Lauftipp has the right but not the duty to check the complete content of Lauftipp for any violations of these terms.

Lauftipp reserves the right to change these Terms and the services of the webpages. If these changes are significant the users will be noticed within an acceptable time frame before the new Terms will become active. The information will be send by mail to your address you submitted while registering on Lauftipp. The Terms will be automatically accepted by the User if he does not respond within 1 month after the mail was send.

For all law issues that might occur while using Lauftipp, the law of the Federal Republic of Germany is effetive. Place of jurisdiction is Bamberg, Germany.
